Statusi i jetimit jepet në zbatim të një Ligji Nr. 8153, dt. 31.10.1996. Statusin e jetimit e përfitojnë të gjithë personat me moshë nga 0-25 vjeç që kanë kaluar ose jo nëpërinstitucionet shtetërore apo private të përkujdesit shoqëror dhe që plotësojnë këto kritere.
Statusi i jetimit jepet nga SHSSH-ja nga një komision specialistësh në nivel drejtorie në përbërje të të cilit është dhe një përfaqësues i Shoqatës së Jetimëve të Shqipërisë. Kjo shoqatë është themeluar vitin 1991 dhe ka si qëllim mbrojtjen e të drejtave të jetimëve dheintegrimin e tyre në komunitet. Kryetar i këtij Komisioni është Drejtor i Përgjithshëm iSHSSH-së. Ky komision mblidhet 1 herë në tre muaj. Personat që plotësojnë kriteret emësipërme përfitojnë nga ky status edhe pasi kanë kaluar moshën 25 vjeç, nëse nuk janëtrajtuar nga shteti me strehim dhe në bazë të Vendimit të Këshillit të Ministrave nr. 49, dt.29.01.1993 “Për përcaktimin e kritereve për të pastrehët”, dhe janë në kushte të vështirajetese.
Jetimët të cilët pretendojnë për përfitimin e këtij statusi përgatisin dokumentacionin emëposhtëm, të cilin e dorëzojnë pranë Zyrave Rajonale të Përkujdesit Shoqëror dhekonkretisht:

Ligjit Nr. 8153, datë 31.10.1996 “Për statusin e jetimit” është një ligj i cili adreson njësërë institucionesh. Ai përcakton detyrime për Ministrinë e Punës, Çështjeve Sociale dheShanseve të Barabarta, Ministrinë e Arsimit dhe Shkencës, Ministrinë e Punëve Publike,Ministrinë e Kulturës, Rinisë dhe Sporteve, Ministrinë e Shëndetësisë, Ministrinë eMbrojtjes. Në bazë të tij, jetimët me status jetimi trajtohen si grup prioritar për të përfituarnga programet që ka çdoMinistri.
